Point Policy

PINGO POINTS POLICY

1.   GENERAL

• Any capitalized words used in this Pingo Points Policy (“Pingo Points Policy”), unless otherwise defined herein, shall have the same meaning as found in the Buyer’s Terms and Conditions, the Seller’s Terms and Conditions and the Pingo Activity Policy. This Pingo Points Policy shall form an integral part of the Buyer’s Terms and Conditions, the Seller’s Terms and Conditions and the Pingo Activity Policy.

  This Pingo Points Policy shall govern the terms and conditions of the Pingo Activity as may be from time to time organised and conducted by PINGO on the Platform, in its sole discretion.

• The Pingo Points Programme (“Points Programme”) is a loyalty programme operated by PINGO and is offered at the sole discretion of PINGO to all Buyers accessing or using the Platform. This Pingo Points Policy governs the terms and conditions of the Points Programme as may be from time to time determined and prescribed by PINGO in its sole discretion. The Buyer is encouraged to read this Pingo Points Policy carefully.

• By using and spending of the Pingo Points (as hereinafter defined) and Redeemable Points (as hereinafter defined) awarded by PINGO, the Buyer hereby agrees to be bound by this Pingo Points Policy, the Buyer’s Terms and Conditions, the Seller’s Terms and Conditions, the Pingo Activity Policy and any other policies and terms and conditions as may be posted on the Platform from time to time (“Other Terms”).

  This Pingo Points Policy is issued in both English and Chinese languages. In the event of any inconsistency between these two versions, the English version shall prevail.

2.   PINGO POINTS PROGRAMME

• Upon successful registration of the Buyer’s account on the Platform, the Buyer shall be automatically enrolled in the Points Programme. PINGO awards two (2) types of reward points under this Points Programme, namely pingo points (“Pingo Points”) and redeemable points (“Redeemable Points”).

• PINGO will set up a wallet for each Buyer to record any Pingo Points and/or Redeemable Points collected or spent by the Buyer (“Wallet”). Should any of the following events occur, PINGO reserves the rights to terminate the Buyer’s participation in the Points Programme and revoke any accrued Pingo Points and/or Redeemable Points:

  • failure to comply with this Pingo Points Policy and/or any of the Other Terms;
  • abuse of any membership privileges;
  • supply false or misleading information to PINGO; or
  • death or bankruptcy.

3.   PINGO POINTS

Once the Buyer has register as a member on the Platform, the Buyer shall be entitled to earn Pingo Points in accordance with Clause 3.2 of this Pingo Points Policy, which may be amended by PINGO from time to time

• Eligibility

  • Once the Buyer has register as a member on the Platform, the Buyer can begin earning Pingo Points and may be awarded Pingo Points at an amount which shall be determined by PINGO through the following manner: -

    • by procuring its Referee to purchase any VIP Merchant Offering via the Platform; or
    • by participating in the Pingo Activity and/or other promotional activities/events on the Platform as may be determined and conducted by PINGO from time to time in its sole and absolute discretion, subject to the relevant terms and conditions of the Pingo Activity Policy;
    • by initiating and/or conducting Pingo Activity, subject to PINGO’s approval and the relevant terms and conditions of the Pingo Activity Policy;
    • by procuring its Referee (as hereinafter defined) who is a VIP Member to initiate and/or conduct Pingo Activity in accordance with the terms of the Pingo Activity Policy.
  • The Buyer shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Pingo Points to Buyer or any other matters relating thereto for whatsoever purposes.
  • The point earnings ratio and manner of the Pingo Points shall be subject to PINGO’s revision and modification from time to time, in its sole and absolute discretion.

• Usage of Pingo Points

  • PINGO may provide the Buyer with cash rebate benefits (“Cash Rebate”), whereby 1 Pingo Points can be redeemed for a Cash Rebate of RM 1.00 , subject that the Buyer shall accumulate a total of 100 Pingo Points in its Wallet (“Minimum Requirement”) to be entitled to the Cash Rebate. PINGO reserves the right to modify or discontinue the Cash Rebate at any time, in its sole discretion without notice to the Buyer.
  • Upon the Buyer’s achieving the Minimum Requirement, the Buyer may be granted with the Cash Rebate to redeem its Pingo Points for the corresponding Cash Rebate value, and PINGO shall be entitled to charge an administration fee, which shall not exceed five percent (5%) of the total amount of Pingo Points redeemed under the Cash Rebate.
  • The Buyer may also utilize the Pingo Points in its Wallet to set off any payment for the purchase of Merchant Offerings by the Buyer under the Platform. For the avoidance of doubt, the Buyer shall not be entitled to utilize the Pingo Points to set off any payment for the purchase of any products that are not listed under the Platform.
  • Further, the Buyer shall be entitled to utilize the Pingo Points in its Wallet to access the VIP Membership Zone, Pingo Activity Zone and/or to purchase Merchant Offerings within the Mall Shopping Zone on the Platform.

• Deduction

  • PINGO shall have the right to deduct any Pingo Points from the Buyer’s Wallet in the following circumstances: -

    • PINGO has issued the Pingo Points in relation to a cancelled Transaction;
    • PINGO has issued the Pingo Points in error;
    • PINGO reasonably suspects that the Pingo Points were issued by means of fraud committed by the Buyer; or
    • any such other circumstances that may be determined by PINGO in its sole discretion.

    For the avoidance of doubt, any Pingo Points deducted under the abovementioned circumstances shall not be refunded and in no event shall PINGO be responsible or liable for such deduction.

  • In the event that the balance of the Pingo Points in the Buyer’s Wallet is insufficient for deduction for any reason whatsoever, PINGO shall have the right to make deduction from the Pingo Points subsequently issued to the Buyer until such outstanding deduction of the Pingo Points have been completely settled and cleared from the Buyer’s Wallet.
  • The Buyer can always check the balance of the Pingo Points in the Wallet on the respective Buyer’s account page. The balance of the Pingo Points as set out in the Buyer’s Wallet shall be conclusive evidence of the same.

4.   REDEEMABLE POINTS

• Once the Buyer has register as a member on the Platform, the Buyer shall be entitled to earn Redeemable Points in accordance with Clause 4.2 of this Policy, which may be amended by PINGO from time to time.
• The Redeemable Points have no cash or monetary value and are not redeemable for cash or currency in any form except for the purposes as stated under Clause 4.4. The Redeemable Points cannot be purchased, resold or transferred, for any value or otherwise, under any circumstances. Save for where PINGO expressly permits, the Redeemable Points shall not be regarded, construed or used as valuable or exchangeable instruments under any circumstances on the Platform.

• Eligibility

  • Once the Buyer has register as a member on the Platform, the Buyer can begin earning Redeemable Points and the Buyer may be awarded Redeemable Points at an amount which shall be determined by PINGO through the following manner: -

    • By purchasing any Merchant Offerings (other than the VIP Merchant Offering as stated under Clause 3.2(a)(i)) within the Mall Shopping Zone on the Platform; and/or
    • By procuring its Referee to purchase Merchant Offerings within the Mall Shopping Zone on the Platform.
  • The Buyer shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Redeemable Points to Buyer or any other matters relating thereto for whatsoever purposes.
  • The point earnings ratio and manner of the Redeemable Points shall be subject to PINGO’s revision and modification from time to time, in its sole and absolute discretion.
  • PINGO may also, from time to time, vary or modify the criteria for the Buyer to be eligible for the award of Redeemable Points.
  • Except for clerical error, the Buyer shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Redeemable Points to Buyer or any other matters relating thereto for whatsoever purposes.

• Redemption

  • The Buyer may utilize the Redeemable Points in its Wallet solely for the purposes of redeeming selected Merchant Offerings (“Redemption Product”) listed under the redemption zone of the Platform (“Redemption Zone”). For the avoidance of doubt, the Buyer shall not be entitled to redeem for any other Merchant Offerings that are not listed under the Redemption Zone, and the Buyer shall not utilize the Redeemable Points to set off any payment for the purchase of Merchant Offerings under the Platform or redeem the Cash Rebate as stated under Clause 3.3(a).
  • The Buyer must follow the necessary steps as may be prescribed by PINGO to redeem the Redemption Product listed under the Redemption Zone (if required). Any redemption of the Redemption Product is subject to additional terms and conditions as may be imposed by PINGO.
  • The Redemption Product is not refundable, returnable or exchangeable, save for any circumstances that PINGO may determine from time to time in its sole discretion.

  • PINGO may, at its sole and absolute discretion and without prior notice to the Buyer, withhold or reject the Buyer’s request to redeem the Redeemable Points for any reason whatsoever, including without limitation to: -

    • The Buyer has insufficient Redeemable Points to redeem the Redemption Product;
    • The Redemption Product is no longer available or is out-of-stock;
    • The applicable Redeemable Points the Buyer wishes to redeem have been converted and/or awarded to the Buyer in error or obtained by the Buyer through any dishonest or fraudulent means or abusive behaviour;
    • PINGO reasonably believes that the Buyer has breached any provision of this Pingo Points Policy and/or any of the Other Terms; or
    • PINGO reasonably believes that the redemption by the Buyer may be suspicious, illegal, involving with any criminal activity.

• Deduction

  • PINGO shall be entitled to deduct the Redeemable Points from the Buyer’s Wallet in the following circumstances: -

    • upon the successful redemption of any Redemption Product under the Redemption Zone according to the separate terms and conditions that may be imposed by PINGO (if applicable);
    • any other functions that may be determined by PINGO from time to time in its sole discretion;
    • PINGO has awarded or converted the Redeemable Points in error;
    • PINGO reasonably suspects that the Redeemable Points were awarded by fraud committed by the Buyer; or
    • any such other circumstances that may be determined by PINGO in its sole discretion.
  • In this connection, PINGO will reflect the deduction of the applicable Redeemable Points in the Buyer’s Wallet.
  • The Buyer may at any time, check the balance of the Redeemable Points, the addition or deduction of Redeemable Points and its redemption history in the Buyer’s Wallet on the Buyer’s account page. The balance of the Redeemable Points as set out in the Buyer’s Wallet shall be conclusive evidence of the same.

5.   GENERAL TERMS OF THE POINTS

• The Pingo Points and Redeemable Points are non-transferable to any third party and shall be strictly for personal use of the Buyer only.
• The Pingo Points and Redeemable Points awarded to the Buyer shall have no expiration date.
• In the event of any dispute or conflict arising from or incidental to the issuance/usage/conversion/redemption and/or any transactions in relation to the Pingo Points and/or the Redeemable Points, PINGO shall be entitled to withhold the issuance/conversion/award/redemption and/or any transaction of the Pingo Points and the Redeemable Points until such dispute is resolved.
• In such circumstances, PINGO’s decision shall be final and the Buyer agrees to be bound by the same and shall comply with all directions and instructions issued by PINGO. The Buyer shall not hold PINGO liable for any matters resulting or incidental to the decision made by PINGO.
• For the avoidance of doubt, PINGO may at any time, in its sole discretion as it deems fit, revoke, adjust, recalculate, suspend and/or cease issuing/converting/awarding any Pingo Points and/or Redeemable Points with prior notice to the Buyer.
• In the event that PINGO discovers the involvement of Buyer in any fraud, abuse of redemption, Cash Rebate and/or set off or any dishonest and fraudulent activities related to the Points Programme, PINGO shall be entitled to forfeit all of the Buyer’s accumulated Pingo Points and/or Redeemable Points, disqualify the Buyer’s participation in the Points Programme and/or terminate or suspend the Buyer’s account.

6.   REFERRAL PROGRAM

• PINGO may award referral benefits (“Referral Benefits”) to any Buyer who successfully refers and introduces individuals to register as a member on the Platform as a Normal Member or VIP Member, as the case may be (“Referee”) and complete such other activities as may be determined by PINGO in its sole and absolute discretion (“Referral Program”).
• Under the Referral Program, the Buyer shall only be awarded with the Referral Benefits as stated under Clause 6.5 by PINGO for its Referee.
• The amount of the Referral Benefits shall be determined by PINGO in its sole and absolute discretion, subject always that the Buyer has at all times, remained compliant with this Pingo Points Policy and/or any of the Other Terms.
• Notwithstanding any provisions in this Pingo Points Policy, the terms and conditions of the Referral Program shall be determined by PINGO in its sole and absolute discretion. PINGO may, at its sole discretion, at any time and without prior notice to the Buyer, withdraw, modify, suspend, revoke or cancel the Referral Program.

• Referral Benefits

  PINGO may award the following Referral Benefits to the Buyer when the Buyer’s Referee spends in the following zones on the Platform in accordance with the following manner:-

  Zone	Benefits
  Mall Shopping Zone	The Buyer shall be entitled to obtain Redeemable Points amounting to 5% of the value of the Merchant Offerings purchased by its Referee.
  Membership Zone	The Buyer shall be entitled to obtain Pingo Points amounting to 5% of the value of the VIP Merchant Offerings purchased by its Referee.
  Pingo Activity Zone	The Buyer shall be entitled to obtain Pingo Points amounting to 5% of the amount of the Net Profit of any Pingo Activity hosted by its Referee.

7.   LIABILITY

• PINGO is an operator of the Platform. To the fullest extent permitted by the applicable laws, neither PINGO nor its affiliates make any guarantees, warranties, or representations of any kind concerning the redemption, cash rebate and/or set-off of the Pingo Points and/or the Redeemable Points by the Buyer under the Points Programme. Any redemption, cash rebate and/or set-off which is prohibited by the applicable laws shall be void.
• In no event shall PINGO be responsible for any risk or be liable for any claim, liability, demand, expenses, loss, costs or damage incurred by the Buyer as a result of, or in connection with the redemption, cash rebate and/or set off of the Pingo Points and/or the Redeemable Points.
• To the fullest extent permitted by applicable laws, the Buyer agrees to indemnify, defend, and hold harmless PINGO, its affiliates, directors, employees, agents, licensors, officers, from any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, arising out of or related to the participation in the Points Programme or the acceptance/redemption of any Pingo Points or Redeemable Points including but not limited to personal injury and damages to property and regardless of whether it is direct, consequential or foreseeable.
• The Buyer shall further indemnify PINGO, its affiliates, directors, employees, agents, licensors, officers, from any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, suffered thereby as a result of the violation of this Pingo Points Policy and/or any of the Other Terms.

8.   VARIATION

• PINGO reserves the rights at any time, at its sole discretion, to change, amend or otherwise modify any part of this Pingo Points Policy by posting the revised Pingo Points Policy on the Platform, and such amendments are effective as of the date of posting. The continued usage of the Platform after the revised Pingo Points Policy is posted constitutes the agreement to, and acceptance of, the revised Pingo Points Policy.
