Point Policy

PINGO POINTS POLICY

1.   GENERAL

• Any capitalized words used in this Pingo Points Policy (“Pingo Points Policy”), unless otherwise defined herein, shall have the same meaning as found in the Policies Terms. This Pingo Points Policy shall form an integral part of the Terms of Service.
• The Pingo Points Programme (“Points Programme”) is a loyalty programme operated by PINGO and is offered at the sole discretion of PINGO to all users accessing or using the Platform. This Pingo Points Policy governs the terms and conditions of the Points Programme as may be from time to time determined and prescribed by PINGO in its sole discretion. The user is encouraged to read this Pingo Points Policy carefully.
• By using and spending of the Pingo Points (as hereinafter defined) awarded by PINGO, the user hereby agrees to be bound by this Pingo Points Policy, the Policies Terms and any other policies and terms and conditions as may be posted on the Platform from time to time.
• This Pingo Points Policy is issued in both English and Chinese languages. In the event of any inconsistency between these two versions, the English version shall prevail.

2.   PINGO POINTS PROGRAMME

• Upon successful registration of the user’s account on the Platform, the user shall be automatically enrolled in the Points Programme. PINGO awards two (2) types of reward points under this Points Programme, namely pingo points credited into your wallet set up by PINGO (“Wallet”) (“Wallet Pingo Points”) and pingo points credited into your profile under “Earning Points” (“Earning Points”) (the Wallet Pingo Points and Earning Points are collectively referred to as “Pingo Points”).

• Should any of the following events occur, PINGO reserves the rights to terminate the user’s participation in the Points Programme and revoke any accrued Pingo Points:

  • failure to comply with this Pingo Points Policy and/or any of the Policies Terms;
  • abuse of any membership privileges;
  • supply false or misleading information to PINGO; or
  • death or bankruptcy.
• Please refer to the Membership Policy for the manner in which the Pingo Points may be awarded, which may be varied by PINGO in its sole and absolute discretion from time to time.

3.   WALLET PINGO POINTS

• Once the user has registered as a member on the Platform, the user shall be entitled to earn Pingo Points in accordance with this Pingo Points Policy, which may be amended by PINGO from time to time.

• Eligibility

  • Once the user has registered as a member on the Platform, the user can begin earning Pingo Points and may be awarded Wallet Pingo Points at an amount which shall be determined by PINGO through the following manner: -

    • by participating in the Pingo Activity and/or other promotional activities/events on the Platform as may be determined and conducted by PINGO from time to time in its sole and absolute discretion, subject to the relevant terms and conditions of the Pingo Activity Policy;
    • by initiating and/or conducting Pingo Activity, subject to PINGO’s approval and the relevant terms and conditions of the Pingo Activity Policy;
    • by procuring its Referee who is a VIP Member to initiate and/or conduct Pingo Activity in accordance with the terms of the Pingo Activity Policy and/or set up its Affiliate Store; and
    • by setting up Affiliate Store to promote and advertise the products and/or services of PINGO.
  • The user shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Wallet Pingo Points to the user or any other matters relating thereto for whatsoever purposes.
  • The point earnings ratio and manner of the Wallet Pingo Points shall be subject to PINGO’s revision and modification from time to time, in its sole and absolute discretion.

• Usage of Wallet Pingo Points

  • PINGO may provide the user with cash rebate benefits (“Cash Rebate”), whereby 1 Wallet Pingo Points can be redeemed for a Cash Rebate of RM1.00 , subject that the user shall accumulate a total of 100 Wallet Pingo Points in its Wallet (“Minimum Requirement”) to be entitled to the Cash Rebate. PINGO reserves the right to modify or discontinue the Cash Rebate at any time, in its sole discretion without notice to the user.
  • Upon the user achieving the Minimum Requirement, the user may be granted with the Cash Rebate to redeem its Wallet Pingo Points for the corresponding Cash Rebate value, and PINGO shall be entitled to charge an administration fee in cash value, which shall not exceed seven percent (7%) of the total amount of Wallet Pingo Points redeemed under the Cash Rebate.
  • The user may also utilize the Wallet Pingo Points in its Wallet to set off any payment for the purchase of products and/or services by the user on the Platform. For the avoidance of doubt, the user shall not be entitled to utilize the Wallet Pingo Points to set off any payment for the purchase of any products that are not listed on the Platform.

• Deduction

  • PINGO shall have the right to deduct any Wallet Pingo Points from the user’s Wallet in the following circumstances: -

    • PINGO has issued the Wallet Pingo Points in relation to a cancelled transaction;
    • PINGO has issued the Wallet Pingo Points in error;
    • PINGO reasonably suspects that the Wallet Pingo Points were issued by means of fraud committed by the user; or
    • any such other circumstances that may be determined by PINGO in its sole discretion.

    For the avoidance of doubt, any Wallet Pingo Points deducted under the abovementioned circumstances shall not be refunded and in no event shall PINGO be responsible or liable for such deduction.

  • In the event that the balance of the Wallet Pingo Points in the user’s Wallet is insufficient for deduction for any reason whatsoever, PINGO shall have the right to make deduction from the Wallet Pingo Points subsequently issued to the user until such outstanding deduction of the Wallet Pingo Points have been completely settled and cleared from the user’s Wallet.
  • The user can always check the balance of the Wallet Pingo Points in the Wallet on the respective user’s account page. The balance of the Wallet Pingo Points as set out in the user’s Wallet shall be conclusive evidence of the same.

4.   PINGO POINTS AS “EARNING POINTS”

• Once the user has registered as a member on the Platform, the user shall be entitled to earn Earning Points in accordance with Clause 4.3 of this Pingo Points Policy, which may be amended by PINGO from time to time.
• The Earning Points have no cash or monetary value and are not redeemable for cash or currency in any form except for the purposes as stated under Clause 4.4. The Earning Points cannot be purchased, resold or transferred, for any value or otherwise, under any circumstances. Save for where PINGO expressly permits, the Earning Points shall not be regarded, construed or used as valuable or exchangeable instruments under any circumstances on the Platform.

• Eligibility

  • Once the user has registered as a member on the Platform, the user can begin earning Earning Points and the user may be awarded Earning Points at an amount which shall be determined by PINGO by purchasing any products and/or services within the Platform.
  • The user shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Earning Points to user or any other matters relating thereto for whatsoever purposes.
  • The point earnings ratio and manner of the Earning Points shall be subject to PINGO’s revision and modification from time to time, in its sole and absolute discretion.
  • PINGO may also, from time to time, vary or modify the criteria for the user to be eligible for the award of Earning Points.
  • Except for clerical error, the user shall not be entitled to request from PINGO, any explanation pertaining to the calculation methods employed by PINGO for the issuance of Earning Points to user or any other matters relating thereto for whatsoever purposes.

• Usage of Earning Points

  • The user may utilize the Earning Points solely for the purposes of redeeming selected products and/or services (“Redemption Product”) listed under the redemption zone of the Platform (“Redemption Zone”). For the avoidance of doubt, the user shall not be entitled to redeem for any other products and/or services that are not listed under the Redemption Zone, and the user shall not utilize the Earning Points to set off any payment for the purchase of products and/or services under the Platform or redeem the Cash Rebate as stated under Clause 3.3(a).
  • The user must follow the necessary steps as may be prescribed by PINGO to redeem the Redemption Product listed under the Redemption Zone (if required). Any redemption of the Redemption Product is subject to additional terms and conditions as may be imposed by PINGO and all delivery fee, customs duties, and taxes and any other charges related to the delivery/shipping and custom clearance of the Redemption Product shall be borne by the user solely.
  • The Redemption Product is not refundable, returnable or exchangeable, save for any circumstances that PINGO may determine from time to time in its sole discretion.

  • PINGO may, at its sole and absolute discretion and without prior notice to the user, withhold or reject the user’s request to redeem the Earning Points for any reason whatsoever, including without limitation to: -

    • The user has insufficient Earning Points to redeem the Redemption Product;
    • The Redemption Product is no longer available or is out-of-stock;
    • The applicable Earning Points the user wishes to redeem have been converted and/or awarded to the user in error or obtained by the user through any dishonest or fraudulent means or abusive behaviour;
    • PINGO reasonably believes that the user has breached any provision of this Pingo Points Policy and/or any of the Policies Terms; or
    • PINGO reasonably believes that the redemption by the user may be suspicious, illegal, involving with any criminal activity.

• Deduction

  • PINGO shall be entitled to deduct the Earning Points from the user’s account in the following circumstances: -

    • upon the successful redemption of any Redemption Product under the Redemption Zone according to the separate terms and conditions that may be imposed by PINGO (if applicable);
    • any other functions that may be determined by PINGO from time to time in its sole discretion;
    • PINGO has awarded or converted the Earning Points in error;
    • PINGO reasonably suspects that the Earning Points were awarded by fraud committed by the User; or
    • any such other circumstances that may be determined by PINGO in its sole discretion.
  • In this connection, PINGO will reflect the deduction of the applicable Earning Points in the user’s account.
  • In the event that the balance of the Earning Points in the user’s profile is insufficient for deduction for any reason whatsoever, PINGO shall have the right to make deduction from the Earning Points subsequently issued to the user until such outstanding deduction of the Earning Points have been completely settled and cleared from the user’s profile.
  • The user may at any time, check the balance of the Earning Points, the addition or deduction of Earning Points and its redemption history in the user’s account page. The balance of the Earning Points as set out in the user’s account shall be conclusive evidence of the same.

5.   GENERAL TERMS OF THE POINTS

• The Pingo Points are non-transferable to any third party and shall be strictly for personal use of the user only.
• The Pingo Points awarded to the user shall have no expiration date.
• In the event of any dispute or conflict arising from or incidental to the issuance/usage/conversion/redemption and/or any transactions in relation to the Pingo Points, PINGO shall be entitled to withhold the issuance/conversion/award/redemption and/or any transaction of the Pingo Points until such dispute is resolved.
• In such circumstances, PINGO’s decision shall be final and the user agrees to be bound by the same and shall comply with all directions and instructions issued by PINGO. The user shall not hold PINGO liable for any matters resulting or incidental to the decision made by PINGO.
• For the avoidance of doubt, PINGO may at any time, in its sole discretion as it deems fit, revoke, adjust, recalculate, suspend and/or cease issuing/converting/awarding any Pingo Points with prior notice to the user.
• In the event that PINGO discovers the involvement of the user in any fraud, abuse of redemption, Cash Rebate and/or set off or any dishonest and fraudulent activities related to the Points Programme, PINGO shall be entitled to forfeit all of the user’s accumulated Pingo Points, disqualify the user’s participation in the Points Programme and/or terminate or suspend the user’s account.

6.   LIABILITY

• PINGO is an operator of the Platform. To the fullest extent permitted by the applicable laws, neither PINGO nor its affiliates make any guarantees, warranties, or representations of any kind concerning the redemption, cash rebate and/or set-off of the Pingo Points by the user under the Points Programme. Any redemption, cash rebate and/or set-off which is prohibited by the applicable laws shall be void.
• In no event shall PINGO be responsible for any risk or be liable for any claim, liability, demand, expenses, loss, costs or damage incurred by the user as a result of, or in connection with the redemption, cash rebate and/or set off of the Wallet Pingo Points and/or the Earning Points.
• Pingo Points could not be replaced in the event that they are lost or stolen due to network disruptions, power outages, virus infection, security breaches of the Platform or your account, third-party platforms’ intervention or any other act not within PINGO’s reasonable control. PINGO shall not be liable for any claims, compensation or losses arising out of such circumstances.
• To the fullest extent permitted by applicable laws, the user agrees to indemnify, defend, and hold harmless PINGO, its affiliates, directors, employees, agents, licensors, officers, from any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, arising out of or related to the participation in the Points Programme or the acceptance/redemption of any Wallet Pingo Points or Earning Points including but not limited to personal injury and damages to property and regardless of whether it is direct, consequential or foreseeable.
• The user shall further indemnify PINGO, its affiliates, directors, employees, agents, licensors, officers, from any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, suffered thereby as a result of the violation of this Pingo Points Policy and/or any of the Policies Terms.

7.   VARIATION

• 7.1PINGO reserves the rights at any time, at its sole discretion, to change, amend or otherwise modify any part of this Pingo Points Policy by posting the revised Pingo Points Policy on the Platform, and such amendments are effective as of the date of posting. The continued usage of the Platform after the revised Pingo Points Policy is posted constitutes the agreement to, and acceptance of, the revised Pingo Points Policy.
